If you have a medical emergency, call the 9-1-1 emergency call system immediately. This service is not used to obtain prescriptions for controlled medications. In addition, the user must be seen only in the state and/or country selected, as physicians are only licensed to see and prescribe for patients in the state and/or country where they are listed as offering the service.

VNET IS NOT, NOR IS IT INTENDED TO BE A MEDICAL HEALTH PLAN

You certify that you are physically located in the state and/or country you have chosen as your current location. You acknowledge that you have been given the ability to access and use the service conditioned on the accuracy of this certification and that the providers you have access to rely on this certification to interact with you. If your certification is erroneous, you agree to indemnify VNET and the Providers with whom you interact for any damages, costs, or claims resulting from such action.

CONTENT OF THE WEBSITE, WEB PORTAL, AND/OR MOBILE APPLICATION

Whenever the term website is used, it refers to the website, web portal, and/or mobile application IOS and Android.

VNET provides the materials on this website solely for your own use for informational purposes only. All website use is subject to the terms and conditions set forth below. By accessing and using this website, you agree to be bound by these terms of use and all other terms and policies that appear on this portal or mobile application.

Please read these Terms and Consent to Use carefully. If you do not agree with any of these, you may not use this website or mobile application and should not fill out any information on it.

Other than information you receive directly from providers, the content of this website should not be considered medical advice. You should always consult a qualified healthcare professional to diagnose and provide treatment, including information about appropriate medications or treatments. RIGHT TO MODIFY

We reserve the right to modify these Terms and Conditions of Use at any time, effective upon posting. Your use of this website following such changes shall be deemed acceptance of any changes. You agree to review these Terms of Use each time you use this website so that you are aware of any changes to these terms.

INTELLECTUAL PROPERTY

All content available on or through the service is the property of VNET or its assignees and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. We give you permission to display, download, store, and print content only for personal and non-commercial purposes. You agree not to reproduce, retransmit, disseminate, sell, publish, broadcast, or circulate the content received through the service to anyone, including, but not limited to, others within your organization. All software and accompanying documentation available for download from the service is the copyrighted work of VNET or its licensors. Any copies of information obtained through the service must include all relevant copyright notices.

Subject to the terms of this Agreement, VNET now grants you a limited, revocable, non-transferable, non-exclusive license to use the software, network facilities, content, and documentation on the Service solely to the extent necessary to access and use the Service.

The license granted herein does not permit you. You agree not to (a) modify, translate, reverse engineer, disassemble, decompile, or create derivative works of the Service, or allow third parties, either directly or indirectly (including but not limited to direct or indirect use of wizards, agents, bots, and other tools), to modify, translate, reverse engineer, disassemble, decompile, or create derivative works of the Service; or (b) transfer, distribute, sell, rent, lease, lease, disclose or provide access to the service to third parties, or use the service to provide service consulting, timesharing or other services to third parties.

WEBSITE ACCESS AND ACCOUNT REGISTRATION

To access the health care service, you must first register for an individual user account (“Account”) and provide certain information. Do not use accented vowels, umlauts, ñ, and/or spaces in your username. Likewise, when typing your personal information (name, surname, address, town), do not use accented vowels, umlauts, ñ, and/or special characters. You may have trouble finding the pharmacy you want and consulting the health care provider. Except for sub-accounts opened for minor children or dependents of whom you are the parent or legal guardian, you agree not to create more than one account and not to create accounts for other persons without first obtaining permission from such persons. You further agree to pay for this service by credit card and acknowledge that medical plans are not accepted (except for Medical Network IPA 300 Medical Group Vital Plan members).

In exchange for your use of the Service and, if applicable, for Providers to send you notices, you agree and consent to: (i) provide true, accurate, current, and complete information about yourself as required by our Account registration form; and (ii) each time you log in, maintain and promptly update such Account information to keep it true, accurate, current and complete. Suppose you provide information that is not true, accurate, current, or complete, or we have reasonable grounds to suspect that such Account information is not valid, accurate, current, or complete. In that case, we reserve the right to suspend or terminate your account and refuse to offer you any and all use of the service now or in the future.

You represent and warrant that you are at least 18 years of age and have the legal right and capacity to agree to these Terms of Use on behalf of yourself or a minor child of whom you are the parent or legal guardian.

INTERNATIONAL USE

This service is designed for and intended for users in Puerto Rico and the United States (certain restrictions apply). VNET makes no representation that the information and services provided on the Service apply to, are suitable for, or are available to users in locations outside the United States. Accessing the Service from territories where the content is illegal and prohibited is prohibited. If you choose to access the Web site from a location outside the United States and/or Puerto Rico, you do so on your own initiative and are responsible for compliance with local laws.

ACCEPTABLE USE

You agree not to access or use the service in any unlawful manner or for any unlawful or illegitimate purpose or in any way that contravenes this Agreement. You will not post, use, store, or transmit: (i) messages or information under a false name; (ii) information that is unlawful, libelous, defamatory, defamatory, obscene, fraudulent, abusive to minors, harassing, threatening or hateful to any person; or (iii) information that infringes or violates any third party’s intellectual property, privacy, or publicity rights. You shall not attempt to disrupt the operation of the service by any method, including the use of viruses, Trojan horses, worms, logic bombs, denial of service attacks, flooding, or spamming. You will not use the service in any way that may cause damage, disable, or impair the service. You will not gain unauthorized access to user accounts, computer systems, or networks through hacking, password mining, or other means. You shall not use robots, scrapers, or other means to access the service for any purpose.

RELIEF OF RESPONSIBILITY

ACCESS TO THE SERVICE AND THE INFORMATION CONTAINED HEREIN IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE PRECEDING, VNET DOES NOT WARRANT THAT ACCESS TO THE SERVICE WILL BE CONTINUOUS OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED, NOR DOES VNET MAKE ANY REPRESENTATION AS TO THE ACCURACY, RELIABILITY, TIMELINESS, QUALITY, COMPLETENESS, USEFULNESS, PERFORMANCE, SECURITY, LEGALITY OR SUITABILITY OF THE SERVICE OR ANY INFORMATION CONTAINED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND YOUR RELIANCE ON ANY OF ITS CONTENTS IS AT YOUR SOLE RISK.

YOU SHALL BE SOLELY AND EXCLUSIVELY LIABLE FOR ANY DAMAGE TO THE SERVICE OR ANY COMPUTER SYSTEM, ANY LOSS OF DATA, OR IMPROPER USE OR DISCLOSURE OF INFORMATION CONTAINED IN THE SERVICE, WHETHER CAUSED BY YOU OR ANYONE ELSE USING YOUR USERNAME OR PASSWORD. VNET CANNOT AND WILL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR LIABILITY ARISING FROM THE FAILURE OF ANY TELECOMMUNICATIONS INFRASTRUCTURE OR THE INTERNET OR YOUR MISUSE OF ANY PROTECTED HEALTH INFORMATION, ADVICE, IDEAS, INFORMATION, INSTRUCTIONS OR GUIDES THAT YOU ACCESS THROUGH THE SERVICE.

LIMITATIONS OF LIABILITY

IF YOU ENCOUNTER PROBLEMS WITH THE SERVICE OR ANY OF ITS CONTENT, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SERVICE. UNDER NO CIRCUMSTANCES WILL VNET, ANY ASSIGNEE OR SUPPLIER OF VNET, OR ANY THIRD PARTY WHO PROMOTES THE SERVICE OR PROVIDES YOU WITH A LINK TO THE SERVICE BE LIABLE IN ANY WAY FOR YOUR USE OF THE SERVICE OR ANY OF ITS CONTENT, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN ANY CONTENT, VIOLATIONS IN ANY CONTENT OF THE INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS OF OTHERS, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT. UNDER NO CIRCUMSTANCES WILL VNET, ITS ASSIGNEES OR NON-MEDICAL SERVICE PROVIDERS, OR ANY THIRD PARTY WHO PROMOTES THE SERVICE OR PROVIDES YOU WITH A LINK TO THE SERVICE BE LIABLE FOR ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, FOR ANY PERSONAL INJURY, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER INFORMATION ON YOUR COMPUTER, AMONG OTHERS) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER UNDER A THEORY OF BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, MEDICAL MALPRACTICE OR OTHERWISE, EVEN IF WE OR THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

USE OF MEMBERSHIP AND/OR SUBSCRIPTION

You understand, agree, and acknowledge that by entering your credit card information on the website and selecting one of the subscriptions and/or memberships, you are voluntarily authorizing VNET to continuously debit you from month to month and/or year to year according to the selected membership the amount of the monthly payment of such membership until you cancel it. Once you purchase the membership, the consultation fees are automatically discounted according to the discount included in the selected membership.

When using the service, you need internet access and a ready device and provide a current, valid, and accepted form of payment that can be updated as required. Unless you cancel your membership before the next billing date, you authorize us to charge your next period’s membership to your form of payment. Payment is made by credit card.

You understand, agree, and acknowledge that your first cycle is billed immediately when you sign up for membership. Your membership automatically renews. Subscription service charges are charged periodically to your payment form on the calendar day corresponding to the beginning of the payment portion of your membership. Consultation fees are charged at the time the appointment is scheduled.

Payment on our platform is made by credit card through the electronic payment processing platform. If the payment cannot be completed satisfactorily due to a lack of funds, the system will recharge the card within 72 hours or until the payment is made.

If payment cannot be made due to expiration, or multiple substantive defaults if the payment method information is not modified, or due to account cancellation, VNET may suspend access to the membership benefit until payment is obtained. The pending charges are authorized as soon as the payment method is updated. This situation could generate a change in the collection dates.

You can cancel your current membership anytime from the website in the membership area by selecting Unsubscribe.

Membership payments are NOT refundable; no refund or credit will be given for unused or partially used membership periods.

If you cancel your membership, the cost per consultation returns to the regular cost of each consultation. To make a membership change, you need to cancel the existing membership by following the cancellation process explained in this document and proceed to select the desired membership.

It is your responsibility to cancel the membership. If you select more than one membership and do not cancel existing memberships, the system will bill you for all memberships established, and VNET is not responsible for such payments. Payments are NOT refundable; no refund or credit will be given for unused or partially used membership periods.

PAYMENT AUTHORIZATION

By agreeing to these terms of use, you authorize VNET to charge your credit card and/or debit card with a credit logo for the total amount of your consultation, subscription, and/or membership.

You agree and understand that this authorization to bill your credit or debit card (including any other payment mechanism accepted by VNET) on a non-refundable basis remains in effect each time an inquiry occurs and/or a non-refundable membership charge is made. To cancel a membership, you need to do so from your profile in the VNET mobile application in the membership area (Subscriptions) by selecting Unsubscribe. If a transaction is declined for Non-Sufficient Funds, I understand that VNET may, at its discretion, attempt to process the charge again at any time. You acknowledge that the origin of transactions to your account must comply with the provisions of United States and Puerto Rico law. You certify that you are the authorized user of this credit card/bank account and will not dispute these scheduled transactions with the bank or credit card company if the transactions correspond to the payment required for the consultation and/or membership selected.

NO REFUND

VNET has a NO Refund Policy. By selecting a Membership or subscription, paying for an immediate medical consultation, or making an appointment to consult with a service provider, you understand and agree that you do so freely and voluntarily and that VNET does not obligate you to do so. Therefore, if you regret or decide to cancel the Subscription, Membership, appointment, or consultation requested or do not show up for the appointment or consultation requested, VNET will NOT refund or reimburse you for any of the above services requested and paid for by you.

CANCELLATION

VNET may suspend or terminate your access to the service at any time, for any reason or no reason. VNET has the right to deny access to the service to any person, agency, or organization at any time, for any reason or no reason, in our sole discretion. VNET reserves the right to change, suspend, or discontinue all or part of the service, temporarily or permanently, without notice.

SERVICE, BENEFITS, RISKS, AND/OR CONSENT OF THE TELEMEDICINE SERVICE

Telemedicine involves using electronic communications to enable health care providers at sites remote from patients to provide consultative services. Providers may include primary care professionals, specialists, and/or subspecialists. Information may be used for diagnosis, therapy, follow-up, and/or education. It may consist of live two-way audio, video, and other materials (e.g., medical records medical device data).

The communications systems will incorporate network and software security protocols to protect the confidentiality of patient information. They will include reasonable measures to safeguard data and ensure its integrity against inadvertent corruption. A summary of the encounter is provided to the patient at the end of each encounter that may be retained for the patient’s records. It may be shared with the patient’s local primary care or other provider.

Among the benefits of telemedicine is improved access to medical care by allowing patients to remain in their homes or offices while seeing a physician, which leads to more efficient medical evaluation and management.

As with any medical procedure, there are potential risks associated with telemedicine. VNET providers believe that the likelihood of these risks materializing is very low. These risks may include, but are not limited to, the following: (i) medical evaluation and consultation or treatment delays may occur due to equipment deficiencies or failures. (ii) Security protocols may rarely fail, causing a breach of privacy of personal medical information. (iii) Lack of access to complete medical records may result in adverse drug interactions, allergic reactions, or other negative outcomes.

BY USING THE TUSALUD VIRTUAL WEBSITE, WEB PORTAL, AND MOBILE IOS AND ANDROID APPLICATION, YOU ACCEPT THESE TERMS OF USE, ACKNOWLEDGE, UNDERSTAND, AND AGREE TO THE FOLLOWING:

You understand that laws protecting the privacy and confidentiality of medical information also apply to telemedicine. You have read and understand VNET’s Notice of Privacy Policies, which explains this in greater detail.

You understand that telemedicine may involve the electronic communication of your personal health information to physicians or health care providers in other areas, including out-of-state.

You understand that you can expect expected benefits from telemedicine in your health care, but that outcome cannot be guaranteed.

You understand that your health information may be shared with others for treatment, payment, and health care operations. Physicians maintain psychotherapy notes but do not share them with others, while billing codes and encounter summaries are shared with others and you. Suppose you obtain psychotherapy from the VNET provider. In that case, you understand that the therapist has the right to limit the information provided to you if, in the professional judgment of your therapist, sharing the information with you would be harmful to you. In addition, you understand that your health information may be shared in the following circumstances: (i) When a valid court order is issued for medical records. (ii) To report suspected abuse, neglect, or domestic violence. (iii) To prevent or lessen a serious threat to the health or safety of any person.

INFORMED CONSENT

By clicking the “ACCEPT” button, you acknowledge that you do not have an emergency condition, we do not accept medical plans (except for Medical Network IPA 300 Medical Group members), you do not expect to receive a prescription for controlled medications, and you are consenting to receive care through the Service and are responsible for payment of the requested service. The scope of care will be at the sole discretion of the treating health care provider and does not guarantee a diagnosis, referral, medical excuse, treatment, or prescription. The health care provider will determine whether the diagnosed or treated condition is appropriate for a telemedicine encounter through the Service. Neither VNET nor the healthcare provider is responsible for delays in medical evaluation, consultation, or treatment due to deficiency or failure of equipment and/or internet connectivity. Neither VNET nor the health care providers are responsible for adverse drug interactions, allergic reactions, or other negative outcomes due to missing or erroneous information in the patient’s health record. After being evaluated and utilizing the service, you agree to see your primary care physician for a follow-up of the condition. If your symptoms worsen or you do not improve, you must visit an emergency room for evaluation and treatment. Therefore, you understand that the Telemedicine Service has limitations regarding physical examination. Contact your primary care physician or the nearest emergency room for assistance if you need a physical exam. The Service respects and protects patient confidentiality of protected health information as required by the Health Insurance Portability and Accountability Act (HIPAA) and, subject to HIPAA regulations, will obtain the patient’s express consent before sharing any patient-identifiable information with third parties for purposes other than treatment, payment, or health care operations.

In addition, by clicking the “ACCEPT” button, you authorize VNET and the Health Care Provider to access, edit, and use personal health information and provide you with marketing materials promoting the Service. You may opt out of receiving such marketing materials by emailing info@vnetpr.com or vnetsupport@vnetpr.com.

You acknowledge that you have read and understand the information provided above and the risks and benefits of Telemedicine. By clicking the accept button and/or agreeing to these Terms of Use, you consent to participate in a Telemedicine visit under the terms described herein.

NON-DISCRIMINATION CLAUSE

VNET complies with applicable Federal civil rights laws and does not discriminate based on race, color, national origin, age, disability, sex, or preference. We also do not exclude or treat people differently because of race, color, national origin, age, disability, sex, or preference.

Privacy Policy

Effective Date: November 27, 2023

VNET (“we”, “us”, or “our”) recognizes the importance of protecting the privacy of your personal information. We have prepared this Privacy Policy to provide important information about the privacy practices applicable to the American Wells Platform used by VNET and any website or service that links to or refers to this Privacy Policy (collectively, the “Services”). In addition, individually identifiable information that you provide to us for purposes of obtaining medical care from VNET providers (such information is also referred to as “Protected Health Information” or “PHI”) will also be subject to VNET’s Health Insurance Portability and Accountability Act Notice of Privacy Practices (the “HIPAA Notice”). The HIPAA Notice describes how VNET providers and we can use and share your PHI and your rights regarding your PHI. To the extent that there is a conflict between this Privacy Policy and the HIPAA Notice concerning PHI, the HIPAA Notice will prevail.

I. COLLECTION OF INFORMATION

We may collect the following kinds of information when you use the Services:

Information you provide directly to us. For certain activities, such as when you register, use our telemedicine services, subscribe to our alerts, or contact us directly, we may collect some or all of the following types of information:

  • Contact information, such as your full name, email address, mobile phone number, and address; – Username and password.
  • Payment information includes your credit card number, expiration date, and security code.
  • For doctors applying for jobs, information about your employment, such as your job title, practice area, primary specialty, and medical license status.
  • Personal health information, including your diagnosis, previous treatments, general health, and health insurance.
  • Any other information you provide to us.

We may combine such information with information we already have about you.

Information we collect automatically. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, information about the links you click and pages you view within the Services and other standard server log information. We may also collect certain location information when you use our Services, such as your computer’s IP address, your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers.

We may use cookies, pixel tags, Local Shared Objects, and similar technologies to collect this information automatically. Cookies are small bits of information stored by your computer’s web browser. Pixel tags are tiny images or small pieces of data embedded in images, also known as “web beacons” or “clear GIFs,” that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. Local Shared Objects (sometimes referred to as “Flash Cookies”) are similar to standard cookies except that they can be larger and are downloaded to a computer or mobile device by the Adobe Flash media player. By using the Services, you consent to our use of cookies and similar technologies.

We may also collect technical data to address and fix technical problems and improve our Services, including the memory state of your device when a system or app crash occurs while using our Services. Your device or browser settings may permit you to control the collection of this technical data. This data may include parts of a document you used when a problem occurred or the contents of your communications. By using the Services, you consent to the collection of this technical data.

We obtained this information from your healthcare providers and other sources. We may collect medical records from your past, current, and future health care providers. This may include information about your diagnosis, previous treatments, general health, laboratory and pathology test results and reports, social histories, any family history of illness, and records about phone calls and emails related to your illness.

We may also receive information about you from other sources, including through third-party services and organizations. For example, suppose you access third-party services through the Services to login to the Services or to share information about your experience on the Services with others. In that case, we may collect information from these third-party services.

II. USE OF INFORMATION

  • Healthcare providers, insurance companies, and other healthcare-related entities.
  • We may share your information with other health care providers, laboratories, government agencies, insurance companies, organ procurement organizations, medical examiners or funeral directors, and other entities providing treatment options and support.
  • Authorized third-party vendors and service providers. We may share your information with third-party vendors and service providers that help us with specialized services, including billing, payment processing, customer service, email deployment, business analytics, marketing, advertising, performance monitoring, hosting, optimization, attribution, de-identification, and data processing. These third-party vendors and service providers may not use your information for purposes other than those related to the services they are providing to us.
  • Research partners. We may share your information with our research partners to conduct health-related research; such sharing may be subject to your separate written authorization.
  • Corporate affiliates. We may share your information with our corporate affiliates subject to this policy.
  • Business transfers. We may share your information in connection with a substantial corporate transaction, such as a website sale, a merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
  • Legal purposes. We may disclose information to respond to subpoenas, court orders, legal processes, law enforcement requests, legal claims, or government inquiries and to protect and defend the rights, interests, health, safety, and security of VNET, our affiliates, users, or the public. Suppose we are legally compelled to disclose your information to a third party. In that case, we will attempt to notify you by emailing the email address in our records unless doing so would violate the law or you have not provided your email address to us.
  • With your consent or at your direction. We may share information for any other purposes disclosed to you at the time we collect the information or under your consent or direction.

Access third-party services through the Services to log in to the Services or to share information about your experience on the Services with others. These third-party services may be able to collect information about you, including information about your activity on the Site. By their privacy policies, they may notify your connections on the third-party services about your use of the Site.

IV. SECURITY

We use reasonable measures to help protect information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.
